Terms and Conditions of Sale

L’Atelier de Julie Sàrl
Route de Jussy 35
1226 Thônex – Geneva, Switzerland
Website: www.latelierdejulie.ch

1. Purpose and acceptance of general conditions

These General Terms and Conditions of Sale (GTC) govern the sales of products offered by L’Atelier de Julie on its website www.latelierdejulie.ch, as well as, where applicable, custom orders placed directly with L’Atelier de Julie.

Any order implies prior consultation and unreserved acceptance of these General Terms and Conditions of Sale by the Customer.

By validating their order, the Customer acknowledges having read and fully accepted these GTC.

2. Entirety

These General Terms and Conditions of Sale express the entirety of the parties' obligations within the context of the order concerned.

Any general or specific condition appearing in documents transmitted by the Customer cannot prevail over these GTC, unless L’Atelier de Julie has given prior written agreement.

3. Artisan products

All products offered by L’Atelier de Julie are handcrafted.

Since biscuits, cakes and other pastries are made and decorated by hand, slight variations in color, shape, finish or decoration may appear from one creation to another.

The photographs, illustrations and visuals presented on our website, social media, quotes or any other communication medium are provided for informational purposes only and are not contractually binding.

L’Atelier de Julie strives to reproduce the models presented or agreed upon with the Customer as closely as possible, but cannot guarantee a result strictly identical to a photograph or a reference model.

4. Product information and allergens

Our products may contain the following allergens:

gluten, eggs, milk and dairy products, tree nuts, soy and other allergens depending on the recipes.

Our products are made in a workshop where different allergens are used. Despite all precautions taken, the possible presence of traces or cross-contamination cannot be completely ruled out.

It is the Customer's responsibility to inform us, before validating their order, of any food allergy or intolerance concerning the people likely to consume the products.

In case of severe food allergy, we recommend that the Customer contact us before placing any order to check if the desired product can be adapted.

5. Product storage

The Customer undertakes to comply with the storage conditions communicated by L’Atelier de Julie and, where applicable, the indications on the packaging.

Biscuits

Individually wrapped biscuits should be stored in a dry place, at room temperature, away from heat, humidity and direct light.

They should not be stored in the refrigerator.

The recommended shelf life is indicated on the packaging where applicable.

Cakes and fresh pastries

Cakes, cupcakes and other pastries containing creams, fresh fruits or preparations requiring cold storage must be kept in the refrigerator in accordance with the instructions provided when the order is delivered.

L’Atelier de Julie cannot be held responsible for product deterioration resulting from non-compliance with transport or storage conditions after its delivery to the Customer.

6. Packaging

Depending on the product and type of order, biscuits may be individually wrapped in an airtight food-grade bag.

Information relating to ingredients, allergens and storage is communicated in accordance with applicable requirements and the type of product concerned.

Orders intended for shipment are carefully packaged to minimize the risk of breakage during transport as much as possible.

7. Orders on the website

Products available in the online store can be ordered directly on www.latelierdejulie.ch.

The Customer is responsible for the accuracy of the information provided during their order, including their contact details, delivery address, email address and telephone number.

The order is considered confirmed after validation of the order and receipt of payment according to the methods proposed when placing the order.

L’Atelier de Julie reserves the right to refuse or cancel an order in case of exceptional unavailability of a product, obvious error concerning the price or product information, or any other legitimate reason preventing its execution.

In this case, any sums already paid for the products concerned will be refunded.

8. Price and payment

The applicable prices are those indicated on the website or on the quote sent to the Customer at the time of the order.

Any delivery, shipping or additional service fees are indicated separately where applicable.

Available payment methods may include Visa and Mastercard, as well as any other payment method offered at the time of order.

An order placed on the online store must be paid in full to be confirmed and processed.

For orders placed with a quote, payment terms are indicated directly on the quote or invoice.

9. Personalized and custom orders

L’Atelier de Julie creates personalized biscuits, cakes and pastries for individuals and professionals, particularly for birthdays, weddings, baptisms, baby showers, corporate events, client gifts, product launches and other events.

The price of a custom creation depends notably on the quantity, dimensions, ingredients, design complexity, level of personalization and production time.

To obtain an accurate quote, the Customer is invited to provide as much information as possible about their project: inspirations, photographs, colors, theme, logo, text, quantities, event date and any other relevant information.

After acceptance of the quote, L’Atelier de Julie and the Customer define, when necessary, the main design elements.

For certain personalized orders, particularly large or professional orders, L’Atelier de Julie may request a 50% deposit to definitively confirm the reservation.

The balance must be paid according to the terms and within the deadline indicated on the quote or invoice.

10. Minimum quantity for personalized biscuits

Depending on the model and the level of personalization requested, a minimum quantity may be required.

Generally, personalized biscuit orders are made from a minimum of 12 to 24 identical pieces or pieces belonging to the same collection, depending on the complexity of the project.

L’Atelier de Julie will specify the applicable minimum quantity when preparing the quote.

11. Logos, colors and elements provided by the Customer

For personalized orders, the Customer undertakes to provide the necessary elements for the execution of the order within the agreed deadlines: logos, texts, colors, illustrations, references or other files.

For large orders, particularly professional events, it is recommended to provide all necessary elements at least 30 days before the desired delivery date, unless otherwise agreed.

The Customer guarantees that they have the necessary rights to use and transmit to us the logos, brands, illustrations, photographs or other protected elements they wish to have reproduced.

L’Atelier de Julie cannot be held responsible for unauthorized use of an element provided by the Customer.

Food colorings and artisan techniques do not always allow for an exact match with a printed color, screen, color code or physical sample. Slight variations in shade are therefore possible.

12. Modification of a personalized order

Any modification request after validation of the quote or design is subject to the agreement of L’Atelier de Julie.

Depending on the progress of the order, the remaining time and the nature of the requested modification, additional costs may be charged.

Certain modifications may be refused if they are made too late to allow their execution under good conditions.

13. Cancellation and postponement

The products offered by L’Atelier de Julie being primarily custom-made, personalized or perishable, their preparation requires specific planning and may lead us to refuse other orders for the same date.

For personalized or quote-based orders, the following cancellation conditions apply unless otherwise specified on the quote:

Any cancellation occurring within 7 days before the scheduled collection or delivery date does not entitle the customer to any refund.

When a deposit has been paid to reserve a date and the order is cancelled by the Customer, sums already incurred for preparation, personalization, purchase of materials or ingredients may be retained within applicable limits.

Any request for a date postponement is subject to the availability of L’Atelier de Julie and must be confirmed in writing.

If the postponement is accepted, additional fees may be applied if preparations have already been made or if products, decorations or personalized items have already been ordered or produced.

14. Collection at the workshop

Orders can be collected at our workshop located at:

L’Atelier de Julie
Route de Jussy 35
1226 Thônex – Geneva

Collection is only possible on the date and during the time slot agreed upon at the time of order.

The Customer is asked to respect the communicated collection time slot to ensure the proper organization of the workshop.

Upon delivery of the order to the Customer, the Customer becomes responsible for its transport and storage.

For fragile cakes and pastries, we recommend flat transport, in a sufficiently cool vehicle and on a stable surface.

15. Delivery

When delivery is offered, the costs are calculated based on the delivery address, distance, order volume, and specific transport conditions, among other factors.

The amount of delivery fees is communicated to the Customer before order confirmation.

The Customer must provide an exact address and a telephone number where they can be reached on the day of delivery.

In case of the Customer's absence or inability to access the indicated address at the agreed time, additional fees may be charged for a new delivery attempt.

16. Shipping by Post

Postal shipping is only offered for products that can be transported under good conditions, particularly certain biscuits.

As an indication, shipping costs may be as follows:

  • up to 22 biscuits: CHF 9.–

  • up to 32 biscuits: CHF 11.–

  • up to 40 biscuits: CHF 13.–

  • for larger quantities: price communicated according to the order.

The final price is confirmed at the time of order based on the weight, volume and type of packaging required.

Biscuits intended for shipment are carefully protected to minimize the risk of breakage during transport.

Despite these precautions, minor breakage due to transport may exceptionally occur.

17. Order verification and complaints

L’Atelier de Julie pays particular attention to the preparation, control and packaging of each order.

It is the Customer's responsibility to check the condition and quantity of the products upon receipt or collection.

In case of obvious error, missing product, non-conforming delivery or significant damage, the Customer must contact L’Atelier de Julie in writing within 24 hours of receiving the order.

To allow examination of the complaint, the Customer must provide their order number or invoice as well as clear photographs of the products and their packaging.

No product should be returned without prior agreement from L’Atelier de Julie.

18. Refund or replacement

When a complaint is acknowledged as justified by L’Atelier de Julie, an appropriate solution will be offered to the Customer depending on the situation.

This solution may include a replacement of the product concerned, a credit note or a total or partial refund.

When a refund is granted, it is made, as far as possible, via the payment method used when placing the order.

19. Personal appreciation of products

Our products being artisanal, certain characteristics may naturally vary slightly from one production to another.

A minor difference in color, shape or finish does not in itself constitute a lack of conformity.

Personal preferences regarding the taste, texture or aesthetic appreciation of a product cannot, by themselves, justify a request for a refund when the product corresponds to the agreed order and does not present any defects.

20. Liability

L’Atelier de Julie guarantees that its products are prepared, handled and packaged with care in accordance with the hygiene rules applicable to its activity.

L’Atelier de Julie cannot be held responsible for deterioration resulting notably from:

  • inadequate transport after order collection;

  • non-compliance with storage instructions;

  • excessive exposure to heat, sun or humidity;

  • storage beyond the recommended duration;

  • improper handling of the product by the Customer or a third party;

  • a case of force majeure.

When the liability of L’Atelier de Julie is established, the Customer's rights are determined in accordance with applicable Swiss law.

21. Photographs and communication

L’Atelier de Julie may photograph its creations to showcase its work on its website, social networks or other communication media.

Unless otherwise requested by the Customer before creation or publication, the Customer agrees that photographs of the products made may be used for presentation and communication purposes.

No personal information allowing identification of the Customer will be published without their consent.

22. Force majeure

L’Atelier de Julie cannot be held responsible for a delay or impossibility to execute an order resulting from an unforeseeable event or beyond its control, notably in case of illness or accident preventing production, major breakdown, power outage, natural disaster, major transport problem or other force majeure event.

In such a situation, L’Atelier de Julie will inform the Customer as soon as possible to find an appropriate solution.

23. Data protection

Personal information communicated by the Customer is used for processing orders, payments, deliveries and, when necessary, for communicating with the Customer about their order.

They are processed in accordance with applicable Swiss data protection legislation and our privacy policy.

24. Applicable law

These General Terms and Conditions of Sale as well as contracts concluded with L’Atelier de Julie are subject to Swiss law.

The mandatory provisions provided by Swiss legislation remain reserved.
